1. Acceptance of Terms
By accessing or using GrowStart AI ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. The Service is operated by GrowStart AI ("we", "us", or "our").
By creating an account, you provide explicit, informed consent under the Digital Personal Data Protection (DPDP) Act, 2023 for us to collect and process your personal data as described in our Privacy Policy. You may withdraw this consent at any time by closing your account (see Section 11). Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
2. Description of Service
GrowStart AI is an AI-powered marketing platform for local businesses. The Service includes:
- AI-powered content generation for social media posts, emails, and marketing campaigns
- Google Business Profile optimization tools
- Lead management and CRM pipeline
- AI-powered review reply generation
- WhatsApp and email campaign tools
- AI chat assistant with booking management
- Google Analytics integration
- Call script generation
3. User Accounts
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to use the Service. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Payments
GrowStart AI offers the following plans:
- Starter (Free): Limited access for individuals testing the product
- Pro (₹999/month): Full access for active small business owners
Paid subscriptions are billed monthly through Razorpay. Prices are in Indian Rupees (INR) and inclusive of applicable taxes. We reserve the right to modify pricing with 30 days advance notice.
5. API Key Usage
Certain AI features require you to provide your own Anthropic API key. You are responsible for all costs associated with your API key usage. We do not store your API key beyond what is necessary for the Service to function. We are not responsible for any charges incurred on your API account.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Generate spam, misleading content, or fraudulent marketing materials
- Attempt to reverse-engineer, decompile, or hack the Service
- Share your account credentials with unauthorized third parties
- Use the Service to build or sell contact lists (in compliance with DPDP Act 2023)
- Exceed fair usage limits as determined by your subscription plan
- Use the Service in a manner that could damage, disable, or impair the Service
7. Intellectual Property
The Service, including its design, features, and technology, is owned by GrowStart AI. Content generated using the Service belongs to you, the user. You grant us a limited license to use anonymized, aggregated data to improve the Service.
8. Data Privacy and Your Rights
Your use of the Service is also governed by our Privacy Policy, which forms an integral part of these Terms. Personal data is stored primarily on AWS servers in Mumbai, India (ap-south-1 region).
Under the Digital Personal Data Protection (DPDP) Act, 2023, GrowStart AI is the "Data Fiduciary" and you, the user, are the "Data Principal". As a Data Principal you have the right to:
- Access a summary of personal data we hold about you and how we process it
- Request correction or completion of inaccurate or incomplete data
- Request erasure of your personal data, subject to legal and contractual retention requirements
- Withdraw consent at any time (see Section 1)
- Nominate a person to exercise these rights in the event of your death or incapacity
- Lodge a grievance with our Grievance Officer (see Section 15) and, if unresolved, escalate to the Data Protection Board of India
Requests should be sent to the Grievance Officer (Section 15) or to support@growstart.ai. We will respond within the timelines mandated by the DPDP Act.
9. Third-Party Integrations and Cross-Border Data Transfer
The Service integrates with third-party platforms including Google (Analytics, Business Profile), Razorpay (payments), AWS SES (transactional email), WhatsApp, and Anthropic Claude AI. Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability or functionality of third-party services.
Some integrations require transferring portions of your data outside India:
- Anthropic Claude AI — text prompts and generated content are processed on Anthropic's infrastructure (United States). No personal data of your end-customers is sent unless you explicitly include it in a prompt.
- Google APIs (Analytics, Business Profile) — operate on Google's global infrastructure.
- WhatsApp / Meta APIs — operate on Meta's global infrastructure.
These transfers occur only to provide the integrated functionality you have chosen to enable. By enabling each integration, you consent to the associated data transfer. We do not transfer personal data to any jurisdiction restricted by the Indian Government under the DPDP Act.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time from your account settings. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

In accordance with Section 8(9) of the Digital Personal Data Protection (DPDP) Act, 2023 and Rule 3(11) of the Information Technology (Intermediary Guidelines) Rules, 2021, the Grievance Officer for GrowStart AI is:
